Operator inattention, operator inexperience, improper lookout, excessive speed, and machinery failure rank as the top five primary contributing factors in nonfatal accidents. Alcohol use is the leading known contributing factor in fatal boating accidents.

As a legal matter, a boating accident occurs when a boat (motorboat, canoe/kayak, pontoon boat, sailboat, jet ski, etc.) is involved in an event or series of events that cause harm, such as property damage, total vessel loss, missing person(s), injury or death.

Typically, victims or their families may be able to sue the operator of the boat for negligence or for failure to provide reasonable safety, the owner of the boat, the manufacturing company, the rental company, or other passengers who acted in a negligent or reckless manner such as throwing someone in the water without a life vest, knowing he or she cannot swim.

Many victims of boating accidents prove negligence with eyewitness testimony, law enforcement reports, and photographs of the accident scene. With this evidence, they must show that (1) the boating accident was caused by carelessness, (2) the victim was caused harm, and (3) the negligent party is responsible for compensation.

Where instruction was known, 77% of deaths occurred on boats where the operator did not receive boating safety instruction. Only 13% percent of deaths occurred on vessels where the operator had received a nationally-approved boating safety education certificate. Source

In 2016, the Coast Guard counted 4,463 accidents that involved 701 deaths, 2,903
injuries and approximately $49 million dollars of damage to property as a result of
