Questions to consider: Does your business offer equipment rentals? You will be at fault if someone's snorkel, goggle mask, scuba tank, or other equipment piece breaks or malfunctions. It could result in a serious accident and a very costly lawsuit. Questions to consider: Do waivers stand up in court? In most cases, they do. However, you must have proof of the signed waiver and the waiver must have sufficient wording for the specified accident. Questions to consider: How dangerous is scuba diving? Each year hundreds of scuba divers and snorkelers are injured, many of whom are killed, in diving accidents. Most dive accidents are preventable; they can occur as a result of improper scuba instructor training , inadequate dive training and/or supervision, equipment failure, dive buddy negligence, and poor judgment Questions to consider: Who is at risk of a lawsuit when a diving accident occurs? Dive operators, the diving instructor, equipment manufacturers, equipment lessor, reckless vessel operators, the breathing gas suppliers, and/or equipment designers.
